A complete request is a description of an item the customer wants to authenticate altogether with at least one picture of the item. The Company will use mathematical models using the picture and other related pictures to assess the authentication of the item.
After the Company has received your complete request and payment, the Company will review it. The company will accept or reject your request.
a) If your request is accepted provide you with an authentication report and a copy of these Terms
b) If the request is rejected, the Company . Causes for the rejection can be that image or the nature of the item are unsuitable for the methods available for the Company to elaborate a report, or by the sole Company's discretion.
The Company gives no representation, warranty or guarantee in the Valuation in respect of an object’s origin, provenance, attribution, condition, date, age or authenticity. The Company makes no representation or warranty in the Valuation that the object will realize the amount at which it is valued upon a contemporaneous or subsequent public or private sale. The Company does not warrant or represent in the Valuation that the object valued is safe, functioning or fit for the purpose for which it was intended.
Terms and Conditions for Aithenticate.Art:
- Aithenticate.Art, the operator of Aithenticate.Art ("Aithenticate.Art" or "Us" or "We") offers authentication, valuation, and appraisal services to you ("You"), for autographed items or works of art for which you provide Us with information about (the "Artwork"), subject to your agreement to adhere to the following terms and conditions. These terms and conditions (the "Agreement") are subject to change at any time, without prior notice.
- The online authentication and valuation services offered by Aithenticate.Art will be based solely on the images and information provided to Us by You. The accuracy of the online authentication and valuation is dependent on the information provided by You regarding the Artwork's description, condition, and provenance, which can greatly affect its value. An online authentication and valuation cannot provide the same level of detail as an in-person appraisal.
- Aithenticate.Art aims to provide an authentication and valuation report based on the Fair Market Price, which is the price at which a willing buyer and a willing seller, without any compulsion to buy or sell, and with both parties having reasonable knowledge of the relevant facts, agree on the sale price of the property in a market where the item most commonly sells and without the necessity of a forced sale. This authentication and valuation reflects our opinion of the fair market value, which is determined by factors such as rarity, comparability to similar items currently being sold in private galleries and public auctions, published sales records, desirability, condition, and recent market trends.
- Aithenticate.Art will provide you with an authentication and valuation report containing high and low estimates of the Fair Market Price, based on the information and photographs of the Artwork provided by You (the "Valuation Report"). Aithenticate.Art reserves the right to refuse to provide you with a Valuation Report without providing any explanation or reasoning.
- The price of the Valuation Report is listed on the Aithenticate.Art website and is subject to change at our discretion. We may also offer special offers and discounts at our discretion. Payments for the Valuation Report are non-refundable, unless the Valuation Report was not provided to You within 6 business days of payment being made and all submitted information was complete and satisfactory. If you choose to accept the Valuation Report despite its late delivery, you will be required to pay 50% of its full list price.
- Aithenticate.Art does not consider reserve prices, sales expenses, commissions, or taxes that may be levied on the sale when preparing the Valuation Report. The authentication and valuation is an estimate of the gross amount a buyer might be willing to pay, ignoring any expenses that may apply.
- You warrant that all information provided to Aithenticate.Art regarding your Artwork is accurate and complete, and Aithenticate.Art shall not be held liable for any errors or omissions due to inaccurate or missing information provided by you. Aithenticate.Art expects that you provide all available documents and information in your possession or control (e.g. invoices, sale receipts, Certificates of Authenticity, previous insurance schedules, previous appraisal reports, etc.).
- By providing Aithenticate.Art with any material (in any form), including images and information (the "Material"), you warrant that you have obtained the right to use the Material and that no third party rights are infringed by providing it to Aithenticate.Art. You grant Aithenticate.Art a worldwide, non-exclusive, perpetual, royalty-free license to use the Material for its own purposes.
- The Valuation Report is intended for your personal use only and may not be reproduced or distributed without the written permission of Aithenticate.Art. The Valuation Report is not a substitute for a formal appraisal and should not be relied upon as such.
- Aithenticate.Art makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability of the services or the information contained in the Valuation Report. Any reliance you place on such information is therefore strictly at your own risk.
- Aithenticate.Art shall not be liable for any losses or damages arising from the use of the services or the Valuation Report.
- Unless otherwise stated, the Valuation Report will be based on the information provided by You, without any physical inspection, restoration work, or other physical action relating to the Artwork, or any research into the Artwork's background or history.
- Our estimate of the Fair Market Price does not guarantee that the same price will be achieved if the Artwork is sold.
If an error is made in the Valuation Report, Aithenticate.Art's liability is limited to the fee paid for the appraisal. The online valuation is provided to you for your use at your own risk, and you have no remedy for damages. Aithenticate.Art will not be held liable and you will have no remedy for damages for any claim of any kind concerning your use of the appraisal, regardless of legal theory and whether arising in tort or contract. In no event will Aithenticate.Art be liable to you for any special, indirect, incidental, or consequential damages of any kind, including but not limited to compensation, reimbursement, or damages on account of loss of present or prospective profits or for any other reason. - The Valuation Report is not an appraisal report and is provided to you only and is not transferable without Aithenticate.Art's prior written consent. It remains the copyright of Aithenticate.Art and may not be used for any official or formal purposes such as, but not limited to, legal proceedings, insurance purposes, or any other purposes. If you need an appraisal report for any of these purposes, please visit the appraisal page on Aithenticate.Art.
- By paying for the Valuation Report, you enter into this binding agreement and acknowledge that the valuation is an estimate that is a matter of reasonable opinion, and as such, opinions about the Fair Market Price may vary and differ from each other. Values may change due to general or specific market conditions, and any individual Artwork may be affected by specific conditions that may not be known at the time of valuation. You should also be aware that the Valuation Report is provided for the date on which it was prepared.
If you do not agree with the above terms or if you do not wish to enter into this binding agreement, do not proceed with this process. - If there is any dispute about or involving the Valuation Report, you agree that the dispute shall be governed by the laws of the state of New York, United States, without regard to conflict of law provisions, and you agree to adjudicate all claims relating to Aithenticate.Art exclusively in the applicable courts located in the state of New York. This does not prevent Aithenticate.Art from seeking injunctive or equitable relief in any court of competent jurisdiction.
You agree to indemnify and hold Aithenticate.Art, its subsidiaries, and affiliates, and their respective officers, agents, partners, and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party arising out of or relating to your acceptance of the Valuation Report, your breach of this Agreement, any breach of your representations and warranties set forth above, or if any information you provided to - The conclusions in the Valuation Report are based on our opinion rather than on fact. Aithenticate.Art does not provide any guarantees or warranties regarding the authenticity, origin, provenance, age, or condition of the Artwork. Aithenticate.Art also does not guarantee the functionality, longevity, or merchantability of the Artwork, or its suitability for any purpose.
- These terms and conditions and the provision of the services by Aithenticate.Art shall be governed by and construed in accordance with the laws of the state of New York, United States. Any disputes arising under or in connection with these terms and conditions or the services shall be subject to the exclusive jurisdiction of the courts of the state of New York.
- If any provision of these terms and conditions is found to be invalid or unenforceable by a court, the invalid or unenforceable provision shall be interpreted in a manner consistent with applicable law to reflect the original intentions of the parties as closely as possible, and the remaining provisions shall remain in full force and effect.
- These terms and conditions constitute the entire agreement between you and Aithenticate.Art and supersede any prior agreements or understandings, whether written or oral.
- You may not assign or transfer any rights or obligations under these terms and conditions without the prior written consent of Aithenticate.Art. Aithenticate.Art may assign or transfer its rights or obligations under these terms and conditions without your consent.
- These terms and conditions shall be binding upon and inure to the benefit of the parties hereto and their respective successors and permitted assigns.
- Aithenticate.Art may change these terms and conditions at any time by posting updated terms on the Aithenticate.Art website. You are responsible for regularly reviewing the terms and conditions, and your continued use of the services after any changes have been made constitutes your acceptance of the updated terms. If you do not agree to any changes, you must stop using the services.
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.
Late or missing refunds
